1. Scope of Services

These terms and conditions ("Terms") govern the engagement of Picture Place or Thing ("Company") to provide photography and/or videography services ("Services") to the client ("Client"). The specific services provided will be outlined in the chosen package from the pricing matrix, with the option for additional add-on features.

2. Project Acceptance & Payment

  • A project is considered accepted by the Client upon written approval of a formal quote.

  • The remaining balance is due on the date specified on the approved quote.

3. Scheduling & Access

  • The Client is responsible for scheduling the photoshoot/videography shoot at a mutually convenient time.

  • The Client is responsible for ensuring the property is accessible to the Company's photographer/videographer during the scheduled shoot time.

  • Any delays caused by the Client's lack of preparation or access to the property may incur additional fees.

4. Property Preparation

The Client is responsible for ensuring the property is presentable for the photoshoot/videography shoot, including:

  • Decluttering and depersonalizing the space (applicable to real estate shoots).

  • Coordinating with occupants to vacate the property during the shoot (if applicable).

5. Copyright & Usage

  • All rights, including copyright, to the photographs and videos produced by the Company remain the property of the Company.

  • The Company grants the Client a non-exclusive, irrevocable license to use the photographs and videos for marketing and promoting the subject property for sale or lease.

  • Any other use of the photographs and videos beyond marketing the property requires written permission from the Company and may incur additional fees.

6. Revisions & Turnaround Time

  • A limited number of revisions (2) are included in each package. Additional revisions will be charged at an hourly rate of $45.

  • Standard turnaround time for edited photos and videos is 2 business days. Rush turnaround options may be available for an additional fee.

7. Cancellation Policy

  • Cancellations made 2 days or more before the scheduled shoot will receive a full refund of the deposit.

  • In the event of inclement weather or unforeseen circumstances, the Company will reschedule the shoot at a mutually convenient time.

8. Limitation of Liability

The Company is not liable for any damages to the property that occur during the photoshoot/videography shoot unless caused by the Company's gross negligence or willful misconduct.

9. Entire Agreement

These Terms constitute the entire agreement between the Company and the Client regarding the Services and supersede all prior or contemporaneous communications, representations, or agreements.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
